ISLAMABAD: Justice Mansoor Ali Shah has informed Chief Justice Qazi Faez Isa of his decision to recuse himself from special or larger benches until the full court reviews the amendment ordinance case.

In his letter, dated October 23, Justice Mansoor referenced the benches formed by the committee established after the amendments to the Supreme Court Practice and Procedure Act 2023, enacted via a presidential ordinance in September 2024.

Sources indicate that the letter was addressed to the Chief Justice in his capacity as head of the Practice and Procedure Committee. Justice Mansoor raised concerns about the 26th constitutional amendment, which resulted in his supersession as chief justice. He stated, “I will not be a part of the special bench until the full court sits on the amendment ordinance.”

The letter also quoted Sir Thomas More, with Justice Mansoor noting, “We often forget, when in power, that the people of this country are watching our actions, and that history never forgives.”
